1. Introduction

These Terms of Service ("Terms") govern your access to and use of BotFriday AI ("Platform", "Service"), an AI-powered recruitment platform operated by BetaCrew Solutions Private Limited ("BetaCrew", "we", "our", or "us"), a company registered in Mumbai, India.

By accessing or using BotFriday AI, you ("Customer", "you", or "your") agree to be bound by these Terms. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Service Description

BotFriday AI is an AI-powered recruitment platform that deploys autonomous agents to help organisations screen, evaluate, and hire candidates faster. The Platform may include agents and features that handle, but are not limited to:

• Parsing, enriching, and scoring candidate resumes and applications
• Scheduling and conducting AI-driven interviews (voice, video, or text-based)
• Generating structured assessments, scorecards, and shortlists
• Automating candidate communication via email, SMS, or other channels
• Integrating with applicant tracking systems (ATS) and other third-party tools
• Providing analytics, reporting, and pipeline management capabilities

We may add, modify, or discontinue agents and features of the Platform at any time. Active subscribers will be notified of material changes.

3. Subscription & Credits

BotFriday AI is offered as a SaaS subscription. Each subscription plan includes a defined allocation of credits that may be used toward screening, interviews, and other platform actions. Credit usage and plan details are described on our pricing page and in your subscription agreement.

Usage estimates displayed on our pricing page (such as the number of resumes screened or interviews conducted per plan) are approximate and provided for illustrative purposes only. Actual credit consumption may vary based on factors including resume length, interview duration, input complexity, response length, AI processing requirements, and the specific configuration of your agents. BotFriday AI does not guarantee that a given number of credits will yield a specific number of actions.

We may offer a trial period at our discretion. Trial terms, including duration and credit limits, will be communicated to you at the time of enrolment.

4. Payment, Renewal & Refunds

• Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected).
• Annual subscriptions run for the full subscription period and cannot be terminated early for a refund.
• Monthly subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing cycle.
• All payments are non-refundable. Because the Platform consumes third-party AI processing tokens on your behalf, credits used cannot be reversed. No refunds or credits will be issued for partial subscription periods, unused credits, or plan downgrades.

5. Data Ownership & Usage

Your Data

You retain full ownership of all candidate data, resumes, job descriptions, and any other content you upload to the Platform ("Customer Data"). We do not claim any ownership rights over your Customer Data.

No Training on Customer Data

We do not use your Customer Data to train, fine-tune, or improve our AI models or any third-party models. Customer Data is processed solely to deliver the services you have requested.

Data Retention & Deletion

We retain Customer Data for as long as your account is active or as needed to provide the Service. You may request deletion of your Customer Data at any time by contacting us. Upon account termination, we will delete your Customer Data within a reasonable timeframe, unless retention is required by law.

6. AI-Generated Assessments & Disclaimer

The Platform generates scores, evaluations, and recommendations using artificial intelligence. These outputs are intended as decision-support tools only and are provided on an informational basis.

7. Telephonic Interviews & Recordings

When you use the Telephonic Interview Agent, voice interviews are conducted and processed by third-party AI voice services on our behalf. These calls may be recorded and transcribed for the purpose of generating interview assessments.

You are responsible for ensuring that candidates are adequately informed about the nature of the interview process, including the use of AI and any recording, in accordance with the laws of your jurisdiction. It is your obligation to obtain any required consents from candidates before scheduling telephonic interviews through the Platform.

8. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party rights
• Discriminate against candidates on the basis of race, gender, age, religion, disability, sexual orientation, or any other protected characteristic
• Upload fraudulent, misleading, or malicious content
• Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code
• Resell, sublicense, or redistribute access to the Platform without our written consent
• Use the Platform for any purpose other than legitimate recruitment and hiring
• Interfere with or disrupt the integrity or performance of the Platform

9. Intellectual Property

All rights, title, and interest in and to the Platform — including its AI models, algorithms, software, user interface, branding, and documentation — are and remain the exclusive property of BetaCrew Solutions Private Limited.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose during your active subscription period. No other rights are granted, whether by implication, estoppel, or otherwise.

You may not use the BotFriday name, logo, or branding in any materials without our prior written permission.

10. Account Suspension & Termination

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe that:

• You have violated these Terms or our Acceptable Use policy
• Your use of the Platform poses a security risk or may cause harm to other users
• You are using the Platform for malicious, fraudulent, or unlawful purposes
• Your account is being used in a manner that could expose BetaCrew to legal liability

Upon termination, your access to the Platform will cease immediately. No refund will be issued for any remaining subscription period or unused credits.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform.
• We are not liable for any inaccurate, biased, or incomplete AI-generated assessments, scores, or recommendations.
• BetaCrew shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of your use of the Platform.
• Our total aggregate liability for any claims arising under these Terms shall not exceed the net fees retained by BetaCrew — calculated as the total fees paid by you minus third-party AI processing and infrastructure costs incurred on your behalf — during the six (6) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless BetaCrew Solutions Private Limited, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform
• Your violation of these Terms
• Any hiring decisions you make based on AI-generated outputs
• Your failure to comply with applicable employment or data protection laws
• Any claims by candidates related to screening, interview, or hiring processes conducted through the Platform

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

14. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email or through the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
